The withdrawal button in Germany (Widerrufsbutton)
Germany implemented the EU withdrawal function in a new § 356a of the Civil Code (BGB), in force since 19 June 2026. German shops call it the Widerrufsbutton.
| Legal basis | § 356a BGB |
|---|---|
| In force since | 19 June 2026 |
| Withdrawal button | Vertrag widerrufen |
| Confirmation | Widerruf bestätigen |
What § 356a BGB requires
- A button labelled "Vertrag widerrufen", or an equally clear wording, available throughout the withdrawal period, prominently placed and easy to reach.
- A statement where the customer gives or confirms their name, the contract or the part of it they withdraw from, and the electronic channel for the acknowledgement.
- A confirmation button labelled "Widerruf bestätigen".
- An acknowledgement on a durable medium without undue delay, with at least the content and the date and time of receipt.
- The withdrawal is on time if it was sent before the period ended.
Points German lawyers highlight
- A footer link is acceptable if it is visually highlighted and clearly separate from the imprint and the terms.
- A login is only allowed where the contract itself requires a customer account. Guest orders must be able to withdraw without logging in.
- The model withdrawal notice (Annex 1 to the EGBGB) has to mention the online function.
- The main practical risk is a warning letter (Abmahnung) from a competitor or an association.
This page summarises the rule. It is not legal advice.
